Hi, I hope you are well.

Just following on from John Megas’s email regarding the next step in the Hardship Assistance process, and as we discussed at our meetings, you may receive an email or letter from Dept Transport from Monday 5 November requesting information to verify your application and maybe a request for additional information such as your 2018 tax assessment.  The government appears to be keeping to their December deadline of mailing cheques to you.  We’re almost there.

You all mentioned to me that your finances have suffered and decreased more so in these last twelve months, so this is an opportunity for you to provide further evidence of your loss of income, due to the transport reforms and the toll taken waiting three years for them to be effected.  I believe the additional information they will request will be based on your income, assets and liabilities.

We have 3 weeks (until Monday 26 November) to provide the additional information and documents, so please don’t hesitate to contact me if you require assistance.

I understand and appreciate you have all been through the ringer, lost income, been emotionally and financially impacted and lost an expected retirement fund, but for the most part you have continued to remain professional throughout these last few years and with myself, which I greatly appreciate.

Please complete the Hardship Application process you started and give the government an opportunity to provide financial assistance, and you receive your cheque before the end of December 2018, just over a month away.  If you are not happy with the amount, then you will have more evidence to state your case and take further action at that point in time, but if you try to interfere in the current process, it could prove detrimental to the outcome.  Please also consider that if you interfere in the process, you will be giving the government an opportunity to gain the upper hand.  They are offering financial assistance, it is just a process you have to undergo before you receive it.

Please also appreciate that the NSW Taxi Council has forwarded a financial submission to the government in addition to the hardship application.  Let your colleagues help you professionally and with industry strength.

Re:   Shooters Fisheries and Farmers Party and TOSBA

With respect to the Shooters Fisheries and Farmers Party and TOSBA, several of you have asked for my advice, but this form of industrial relations activity which is politically driven is not my area of expertise, and the directive from my head office is that I should not get involved, however, it is my job to assist you transition through the changes from a business perspective and it would be remiss of me to not to at least provide you with information to assist you make an informed decision on your next course of action, rather than just allowing you to be led down one avenue, so I can provide advice on potential business impact.

As you are aware, the course of action offered by the Shooters Fisheries and Farmers Party and TOSBA is politically driven which means the results for you hinge on the political achievement of the Shooters Fisheries and Farmers Party.  If this does not occur, and no one at this point in time can guarantee they will get in at the next election, or gain one of a balance of power positions, their promises may not be able to be met.  What is their back up plan?  What if they don’t get in?   All that would be achieved is you as individuals, your families, children, and ITN will be thrust into the media again as unprofessional.

Can the Shooters Fisheries and Farmers Party and TOSBA provide you with a written guarantee that they will meet their promises no matter what the outcome of the election?  This is a business requirement, and will protect you and your family, so you will not be left to face any fall out on your own.

You are all proud men and women and I know you and your families have been massively impacted by the new environment in which you work, and you feel you need to do something, but you are doing something, moving forward, rising above the external influences through this Hardship Assistance process, and there are other professional avenues to follow; consider following the Melbourne Taxis with legal action.

I know your motivation is not bullying and thuggery against the government, because you all know, bullying and thuggery is not tolerated anywhere, especially under ITN’s Code of Conduct.  So, what is your motivation?  What do you hope to achieve?   The government is offering you financial assistance, you only have to wait just over a month to find out what that will be.

We know what the Shooters Fisheries and Farmers Party will get out of your participation, your vote, but just because they get into parliament doesn’t mean they can do what they want. There will be more processes they will have to follow in government, just like everyone else elected into Parliament.

Please also note that I have advised the ITN Board to seek legal advice as a matter of urgency with respect to the potential ramifications and fall out from the course of action some of you are considering taking by joining with the Shooters Fisheries and Farmers Party and TOSBA.  You are members of ITN and what happens to you, impacts on ITN, WRC, the Brand.

Ask yourself, ask the Shooters Fisheries and Farmers Party or TOSBA representatives why the taxi drivers north of Sydney, declined to follow them down this course of action.

Please also consider the impact this course of action will take on your partner and children.

Please also understand that your actions will impact on every other taxi driver in the country.  Don’t lead your colleagues and their families into battle when you have an opportunity to gain some financial assistance in the next month; where you have an opportunity to show your professionalism.  Show the public, your customers that you are strong, can rise above the competition because you provide a better service, because you are safer, because you are professional drivers, and because you care.

I would appreciate you considering that there are various avenues for you to move forward with, not just what is being offered by the Shooters Fisheries and Farmers Party and TOSBA.

Since regulation, government action has been a litany of broken promises
and the only promise delivered on time to date has been the levy.

Remember, the “Immediate financial assistance” – took over a year to
distribute and then was taxed on our top dollar income.

Or, Taxis shall have exclusive access to rank & hail. Yeah right!

The $142 million allocated for “hardship” (no compensation for loss)
To date not a cent has been distributed even though applications were
scheduled to open in November 2016 and close by July 2017.
And don’t forget, any payments will be taxed.

The list of broken promises goes on and on.

Prior to this time we have been let down or actually betrayed.
Fred Nile indicated he was going to support us – and did nothing.
Nick Xenophon offered support and dumped us as soon as he was
elected.
So yes, we can’t make promises and neither can the SFF Party.
All we can do is try our best to garner support for justice.
But contemplate the following fact.
Since the beginning, not a single Labor or Liberal politician has ever
offered assistance for our plight. Only members of the SFF party have
addressed Parliament to explain our situation and call for justice.

In answer to Deborah Sams notification – some information has been
revealing:
Surprise news that we may be receiving notice from the Dept.Transport
on the 5th November requiring additional information with only three
weeks to answer – was anyone informed previously? – was there not
enough to confuse in the original application?

As Deborah appears to be in the know, can she guarantee the
Governments “deadline for mailing cheques” ?

Take particular note of Deborahs threat (repeated twice)
“ If you try to interfere in the current process it could prove detrimental to
the outcome.”

Apparently, talking to the wrong people who are seeking justice is in the
eyes of the Business Advisor “interference” and you will be punished.

Perhaps Deborah should be reminded that many of our members came
to this Nation to escape the very tyranny she proposes.

Regarding the discourse on Shooters Fishers & Farmers & TOSBA.

Ms Sams appears unable to comply with a directive from her Head Office
that she should not get involved. It was good advice.

Unfortunately, she has become involved.
Unfortunately and apparently knows little of what she is talking about.

Ms Sams has made disparaging comments that should be addressed.

Ms Sams purports to provide advice on potential business impact.
Her Head Office should inform her that there can be ramifications for
professionals providing erroneous advice.

Her claims are particularly wrong in the following context and based on
entirely erroneous assumptions.

The Shooters Fishers & Farmers Party and TOSBA have made no
promises whatsoever either actual or implicit.

The Shooters, Fishers and Farmers Party only guarantee is that they will
support our cause in fighting for justice being brought to our Industry by
whatever means available to them.

Not a single politician from other parties have offered support.

The same applies to TOSBA who believe that the Taxi fraternity is
drivers, lease holders, operators and owners & not TfNSW.
We all rely on each other and our fight is for all members.
Note: All TOSBA members have sacrificed their own time and money to
fight for our cause.

Ms Sams claims bullying and thuggery is not tolerated anywhere but is
not the entire context of her “advice “ not bullying and thuggery by
threatening repercussions if you talk to “the wrong people”

The following are a classic examples of Ms Sams attempt to intimidate.

MS Sams quotes:
Please also note that I have advised the ITN Board to seek legal advice as a matter

Please also consider the impact this course of action will take on your partner and
children.

Don’t lead your colleagues and their families into battle when you have an opportunity
to gain some financial assistance in the next month

The good old stick and the carrot.

So the threats are :
We know who you are (because we will have our spies at your meetings)
and if you talk to the wrong people we will see that your application for
hardship is compromised.

So be good little boys & girls and if your are lucky (or one of our mates
apparently) we may throw you a few crumbs to tide you over for a short
while. Oh, and don’t forget, we will be taxing it on your top dollar income.

Stalin would be proud.

While we are at it, lets look at the “hardship” Package.
The conditions imposed in the current application make the following self
evident.
Unless you are currently eligible for the pension, you will probably get
nothing.
If you have saved a few bob or have any decent assets after a life time of
work, you will probably get nothing.
Hard luck if what you have runs out in a couple of years.

As Ms Sams seems to like guarantees and is apparently privy to
information unavailable to us.

Can she guarantee that all “hardship” cheques will be sent out in
December.

Alternately, can she advise a final distribution date for all moneys.

Can she advise how many applications have been received.

Can she advise how many applications have been successful.

Can she advise the financial range of the moneys to be distributed to
individuals.

Can she advise what contingencies are in place to cater for the eligible
aged or infirm who found it entirely impossible to plough through the
ludicrous, demeaning and extremely private information required to be
supplied with the application.

As for Ms Sams sweet little “gotcha moment” – repeated below.
Ask yourself, ask the Shooters Fisheries and Farmers Party or TOSBA
representatives why the taxi drivers north of Sydney, declined to follow them down
this course of action.

Yes, we were promised a convoy from Newcastle to Sydney.

Of which Ms Sams public service mates would have gleefully reported.

But the promise was made by a Liberal Party stooge who had gained our
trust and betrayed us at the last moment.
So the convoy was cancelled.

To our Illawarra Mates – Hang in there. Its not over yet.
Its just beginning really.

Must be tough on the Public Gravy train.

Wonder if MS Sams has had 300 grand knocked out of her Super in the
past couple of years or perhaps a 60% reduction in her take home pay.
